The Weightless Triumph of Woke
No statute, no problem. The most sweeping social revolution of our era—diversity, equity, inclusion, the whole “woke” package—arrived without so much as a federal charter. Instead, it colonized institutions through moral shame and PowerPoint hygiene.
Compliance by vibes. Boards green-lighted six-figure DEI budgets because Twitter mobs can wipe out a decade of brand equity in an afternoon. That fear is cheaper than lawyers, so the spreadsheets slide through.

Tech’s Heavy Ankles
Invent, repent, repeat. Launch a new AI tool and regulators immediately want risk audits, bias reports, opt-out buttons, and maybe a public flogging.
The knowledge gap is real. Lawmakers still confuse “Finsta” with a product line, yet they’re drafting existential laws about algorithmic fairness. Meanwhile, the people who actually understand the code spend their days red-lining compliance checklists instead of building features.
Precaution on steroids. Europe wields the precautionary principle like Thor’s hammer; the U.S. is catching up with hearings, task forces, and bipartisan anxiety. Both continents assume tech is guilty until proven boring.

Why the Double Standard?

STEM-Parched Parliaments
Most lawmakers aren’t scientists or engineers. That’s fine in principle—democracies should represent society, not just PhDs in signal processing. The problem isn’t the lack of diplomas; it’s the lack of scientific method in the legislative process.
In culture wars, politicians outsource judgment to elite consensus. If the academy says a new ethics framework is “the right side of history,” who wants to be the provincial rube arguing RCTs and effect sizes? Safer to nod.

Politicians are status readers. In universities, status runs on peer review, citation networks, and moral authority. Technologists, by contrast, have no unified clergy. They argue on GitHub, ship a preprint, and move on. Easier target. The Courage Gap
There’s a specific kind of political courage missing today: the courage to tell your smartest friends they might be wrong. It’s easier to regulate strangers (engineers and founders) than to challenge colleagues in the faculty lounge.

Hard rules for code written by people who never shipped anything.
Soft vibes for culture overseen by people who never A/B tested anything.

EU vs. US: Different Tunes, Same Dance
EU: Masterclass in precaution without mastery. Dense, earnest frameworks promise “trustworthy” tech, drafted in quasi-philosophical prose. The goal—protect rights and dignity—is laudable. The execution—front-loading compliance before comprehension—is how you export your best founders.
US: Masterclass in theater without statutes. Hearings as performance art. White papers as delay tactics. “Voluntary commitments” as mood lighting. Still better at producing companies, worse at producing coherent rules.
Both end up with the same structural sin: regulating the thing you least understand while genuflecting to the thing you most fear socially.
The Cost of Regulating What You Don’t Speak
When non-scientists regulate science, three predictable failures show up:
Category errors. Laws that treat stochastic systems like vending machines: put in audit, get out fairness. Sorry—non-determinism doesn’t bargain.
Frozen progress. If compliance is front-loaded and evidence is post-hoc, you bias toward incumbents and paperwork natives. Startups die by a thousand checklists.

Before a sweeping social or tech rule, publish your hypotheses and metrics. What moves, by how much, and by when? No metrics, no mandate.
2) Sandboxes with telemetry.
Pilot in controlled domains, instrument outcomes, then scale. If you wouldn’t deploy a model globally without staged rollouts, don’t deploy laws that way either.
3) Adversarial panels.
Put dissenters in the room on purpose—engineers to attack tech rules, empiricists to attack social programs. Record the sparring; require written replies. Iron sharpens iron, and all that.
4) Sunset by default.
Every big policy (social or technical) expires unless re-justified with fresh data. Renewal is earned, not presumed.
5) Literacy minimums.
No, not STEM degree litmus tests. But basic fluency tests for committees overseeing tech: probability, causal inference, model evaluation. And for social policy committees: survey design, treatment effects, external validity. If you can’t explain false positives and power, you shouldn’t be writing rules that hinge on them.
6) Swap the courage.
Be braver with your friends (academia), humbler with your strangers (engineers). Challenge comfortable theories; seek mastery before mandates.
The Quiet Fix No One Wants
The real fix is boring: build a scientific civil service—a permanent cadre trained in stats, experimentation, and systems thinking, on loan across ministries and parliaments. Pair them with domain builders who’ve shipped real things. Reward being right after being wrong instead of never being measurable.
Because until we inject method into the moralizing and humility into the rule-writing, we’ll keep getting the same lopsided world: culture governed by prestige, technology governed by fear. And the people without scientific training will continue to regulate scientific domains, loudly—while whispering apologies to their academic friends for not clapping hard enough at the seminar.
That’s not leadership. That’s status maintenance—and it’s throttling both justice and innovation.
